TERMS OF SERVICE AGREEMENT

​Mid Air CX, a Mid Air Communications Company

​Welcome to Mid Air CX. These terms and conditions govern your access to and use of the website and services provided by Mid Air Communications LLC and its subsidiaries (collectively, the "Site" or "Services"). By accessing or using the Site, you agree to be bound by these terms and conditions.

​1. Use of the Site

​Mid Air Communications LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the Site for your personal or internal business use only. You may not use the Site for any other purpose without prior written consent.

​2. User Content

​You retain all rights in, and are solely responsible for, any User Content you upload, submit, store, send, or receive through the Site.

​3. Prohibited Conduct

​You agree not to engage in any of the following activities:

​Violating any applicable law or regulation;

​Posting or transmitting infringing, defamatory, or offensive content;

​Impersonating any person or entity;

​Interfering with or disrupting the Site or its connected networks;

​Using automated means (bots/scrapers) to access the Site or collect data;

​Reverse-engineering any part of the Site.

​4. Account Termination and Outstanding Balances

​To fully close or terminate an account, the subscriber must pay any and all past due balances in full. Termination of service does not relieve the subscriber of the obligation to pay accrued charges or any outstanding debt owed to Mid Air CX.

​5. Equipment Return and Collections

​Upon cancellation of an account, the subscriber is responsible for the following:

​Return Period: All company-owned equipment must be returned to Mid Air CX within thirty-five (35) days of account cancellation.

​Failure to Return: If equipment is not returned within the 35-day window, the full replacement cost of the equipment will be added to the subscriber’s total outstanding balance.

​Collections: Accounts with outstanding balances or unreturned equipment costs may be subjected to collection attempts by Mid Air CX, its subsidiaries, and/or third-party collection agencies if the debt is not settled within the allotted time or as required by law.

​6. Intellectual Property

​Mid Air Communications LLC owns all right, title, and interest in and to the Site and Services. You may not use any trademarks, logos, or proprietary information without prior written consent.

​7. Disclaimer of Warranties

​THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Mid Air Communications LLC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, Mid Air Communications LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

​8. Limitation of Liability

​Mid Air Communications LLC WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SITE, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.

​9. Indemnification

​You agree to indemnify and hold harmless Mid Air Communications LLC and its officers, directors, and employees from any claims, damages, or expenses (including attorney's fees) arising from your use of the Site, your User Content, or your violation of these terms.

​10. Modification of Terms

​Mid Air Communications LLC reserves the right to modify these terms and conditions at any time by posting updated versions to this page.
